Welcome to OpenWater Charters! By booking a fishing trip or using our services, you agree to the following terms and conditions. Please read these terms carefully before making a reservation or using our website.
1. Agreement to Terms
By booking a trip or using our services, you agree to be bound by these Terms of Service and any additional terms or conditions that apply to specific services or promotions offered by OpenWater Charters. If you do not agree to these terms, please do not book a trip or use our services.
2. Booking and Payments
- Reservations: To reserve a fishing trip with OpenWater Charters, you must provide information, including your name, contact details, and payment information. OpenWater Charters uses a third-party website, Fishingbooker, for all private charter bookings. By making a booking through Fishingbooker, you agree to their terms and conditions as well.
- Payment: All payments must be made in advance at the time of booking. We accept Cash, Visa, MasterCard, American Express. The full amount is due upon booking, unless otherwise stated.
- Cancellations and Refunds:
- Cancellations made at least 3 days before the scheduled trip may receive a full refund.
- Cancellations made less than 3 days before the trip are non-refundable.
- If OpenWater Charters must cancel a trip due to weather conditions, mechanical failure, or other unforeseen circumstances, a full refund or rescheduling option will be provided.
3. Fishing Trip Requirements
- Age and Experience: All participants must be at least 18 years old unless accompanied by an adult. No prior fishing experience is required, but participants should be in good health and able to engage in outdoor activities.
- Safety: For your safety, all anglers must follow the instructions of the captain and crew during the trip. Life jackets and other safety equipment will be provided.
- Weather: All trips are subject to weather conditions. OpenWater Charters reserves the right to cancel or reschedule trips if weather conditions are unsafe for fishing.
4. What’s Included
- OpenWater Charters provides all necessary fishing gear, including rods, reels, bait, and tackle.
- A cooler with ice will be provided for food and drinks you bring along.
- We will clean and bag your catch at the end of the trip. (Note: Porgy cleaning is limited to 30 fish.)
5. Responsibilities of the Customer
- Respect for Crew and Equipment: Customers must treat the crew, fellow anglers, and the equipment with respect. Any disruptive or unsafe behavior will result in immediate termination of the trip without a refund.
- Personal Items: Customers are responsible for their personal belongings during the trip. OpenWater Charters is not responsible for lost or damaged personal items.
- Health and Safety: You are responsible for notifying the captain and crew of any health issues or special needs before the trip.
6. Limitations of Liability
- OpenWater Charters is not responsible for any injuries, accidents, or damages that occur during the trip, except where such liability is imposed by law.
- We are not responsible for any lost, damaged, or stolen personal property during your fishing trip.
- OpenWater Charters does not guarantee specific fishing results. Fishing is a recreational activity and outcomes can vary based on factors such as weather, tides, and fish availability.
7. Privacy
Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information when using our website or booking a trip.
8. Intellectual Property
All content on the OpenWater Charters website, including text, images, logos, and graphics, is the property of OpenWater Charters and is protected by copyright law. You may not use any of our content without prior written permission.
9. Modifications to Terms of Service
OpenWater Charters reserves the right to update or modify these Terms of Service at any time. Any changes will be posted on our website with the revised date. It is your responsibility to review these terms periodically.
10. Governing Law
These Terms of Service are governed by the laws of New York State. Any disputes related to these terms will be resolved in the appropriate courts of New York State.
11. Third-Party Service (Fishbooker)
OpenWater Charters uses Fishbooker, a third-party booking platform, for private charter bookings. By using Fishbooker to make a reservation, you agree to their Terms of Service and Privacy Policy in addition to the terms outlined in this document. OpenWater Charters is not responsible for any issues or disputes related to the use of the Fishbooker platform.
